1. General provisions

  1. This document is a public offer to conclude an agreement for access to the Budget Planner Plus web service (the "Service").
  2. The party that published this Offer and provides access to the Service is referred to as the "Service Provider".
  3. The Service is provided via a browser, including the option to install it on a device as a PWA. Under this Offer, the User is granted the right to access the Service, and no software is transferred as property.
  4. This Offer, the Privacy Policy, and other rules and information posted in the Service or on the official website form an integral part of the terms of use of the Service.
  5. By starting to use the Service, registering, logging in, paying for access, or actually using any functionality of the Service, the User confirms that they have read this Offer in full, understand it, accept it without reservation, and agree to comply with it.

2. Subject of the Offer

  1. The Service Provider grants the User a limited, non-exclusive, non-transferable right to access and use the Service solely for personal non-commercial purposes, within and by the means set out in this Offer and the Service functionality.
  2. Nothing in this Offer transfers to the User any exclusive rights to the Service, its code, interface, design, content, databases, trademarks, or other intellectual property.

3. Use of the Service

  1. The Service may be provided under a trial period. The length of the trial, the scope of functionality during that period, and the terms of provision are determined by the Service Provider at its discretion and are indicated in the Service at the start of use.
  2. After the trial period, access to certain functions of the Service may be restricted in full or in part until payment.
  3. If the Service indicates "lifetime access", this means the right to use the paid functionality without a time limit for as long as the Service actually exists, is maintained, and is provided by the Service Provider. Lifetime access does not mean a perpetual or unconditional obligation of the Service Provider to maintain, preserve, develop, or provide the Service.
  4. The Service Provider may at any time at its discretion:
    • change the composition, content, interface, design, and functionality of the Service;
    • change access terms, the set of paid and free features, trial period length, pricing, and payment procedure;
    • suspend, restrict, or discontinue access to the Service or certain features;
    • discontinue support and development of the Service in full or in part.
  5. The actions described in this section may be taken by the Service Provider at any time, without prior notice to the User and without compensation, unless such compensation is expressly required by applicable law.
  6. Payment for access, where applicable, is voluntary and is made only upon the User's explicit action. No automatic charges are made unless expressly stated in the terms of a specific payment method that the User has separately accepted.
  7. The User independently assesses the suitability of the Service for their purposes and assumes all risks associated with using or being unable to use the Service.

4. Changes to the Offer

  1. The Service Provider may at any time unilaterally change, supplement, replace with a new version, or withdraw this Offer without prior notice to the User.
  2. A new version of the Offer takes effect when it is posted in the Service or on the official website, unless the Service Provider specifies another effective date.
  3. The User must independently check for the current version of the Offer. The Service Provider is not obliged to notify the User separately of changes to the Offer.
  4. Continued use of the Service after a new version of the Offer is posted constitutes the User's full and unconditional acceptance of that version.

5. Limitation of liability

  1. The Service is provided "as is" and "as available".
  2. The Service Provider does not guarantee that:
    • the Service will meet the User's expectations, goals, or requirements;
    • the Service will be provided continuously, on time, without errors, failures, or interruptions;
    • results of using the Service will be accurate, reliable, or fit for any purpose;
    • any errors or defects will be corrected;
    • the User's data will be preserved in any amount or for any period.
  3. To the maximum extent permitted by law, the Service Provider is not liable for any loss, damage, expense, lost profit, data loss, blocks, third-party claims, downtime, technical failures, errors, unavailability of the Service, deletion of information, changes to functionality, discontinuation of the Service, or other adverse consequences of using or being unable to use the Service.
  4. The Service Provider is not liable for:
    • the User's actions or inaction;
    • decisions made by the User based on information obtained when using the Service;
    • incompatibility of the Service with the User's devices, software, browsers, networks, or settings;
    • the operation of banks, payment systems, carriers, hosting providers, browsers, or any third parties;
    • any data entered, deleted, modified, or not saved by the User.
  5. The User uses the Service entirely at their own risk. The Service is for informational and practical use and is not financial, investment, accounting, tax, or other professional advice.
  6. If applicable law does not allow full exclusion of liability, the Service Provider's liability is in any case limited to the minimum permitted by such law.

6. Pricing, refunds, and discontinuation

  1. Current access pricing and other payment terms are indicated in the Service or on the official website at the time of payment.
  2. Unless expressly required by mandatory provisions of applicable law, amounts paid:
    • are not refundable;
    • are not recalculated;
    • are not compensated for non-use, partial use, changes to functionality, temporary unavailability, or discontinuation of the Service.
  3. The User may stop using the Service at any time. Such discontinuation does not obligate the Service Provider to refund money unless expressly required by mandatory law.

7. Intellectual property and use restrictions

  1. All rights to the Service and its elements belong to the Service Provider or the respective rights holders.
  2. The User may not:
    • copy, modify, decompile, disassemble, or adapt the Service;
    • circumvent technical restrictions, authentication, or access controls;
    • use the Service for commercial purposes, on behalf of third parties, or for the benefit of third parties without the Service Provider's written consent;
    • transfer access to the Service to others, unless expressly allowed by the Service functionality.

8. Governing law and dispute resolution

  1. The law applicable to the relationship between the Service Provider and the User is determined in accordance with applicable legislation.
  2. All disputes are to be resolved by negotiation. If agreement is not reached, the dispute is to be resolved in the manner and court determined by applicable law.
  3. If any part of this Offer is held invalid or unenforceable, the remaining provisions remain in effect.

9. Final provisions

  1. The User confirms that they use the Service voluntarily, at their own risk and responsibility.
  2. The User confirms that before using the Service they received all necessary and sufficient information about the Service, its functionality, pricing, limitations, and terms of use.
  3. This Offer is effective from the time it is posted and remains in effect until withdrawn by the Service Provider or replaced by a new version.
